1. Introduction and acceptance

1.1 These Terms and Conditions (the "Terms") govern your use of IshuriAI, an AI tutoring service for secondary school learners delivered over USSD short code *384# (the "Service").

1.2 The Service is provided by rero LTD, a company registered in Rwanda with its office at 1 KN 78, Indangamirwa, Kiyovu, Nyarugenge, Kigali, Rwanda ("rero", "we", "us" or "our").

1.3 These Terms apply to everyone who uses the Service. They are published at www.ishuriai.rw/terms, together with our Privacy Notice at www.ishuriai.rw/privacy. By dialing *384# or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.

1.4 These Terms are available in English, Kinyarwanda and French.

2. Definitions

Term Meaning
User A person using the Service, including learners, teachers and parents.
Parent or Guardian The person with legal parental responsibility for a User under 18.
School A school or institution that takes part in an IshuriAI pilot or program.
Partner A funder, mobile network operator or other organization working with rero on the Service.
Session One continuous USSD interaction that starts when *384# is dialed and ends when it times out or is closed.
Content Questions, messages and other information you send to the Service.
Output Answers and other responses generated by the Service.
Pilot The free introductory phase of the Service, as announced by rero.
Operator The mobile network you use to reach the Service, currently MTN Rwanda.

3. Who may use the Service

3.1 The Service is designed for secondary school learners in Rwanda. Teachers, parents and other adults may also use it.

3.2 Users under 16. Most users are 16 or older. If you are under 16, you should use the Service with the knowledge of a parent or guardian, and you should not type personal details into your questions.

3.3 Parents and Guardians. If a child in your care uses the Service, please guide their use. You may ask us at any time to delete your child's data (see section 8).

3.4 Phone ownership. Many users use a phone that belongs to a family member. The owner of the phone is responsible for use of their number, and sessions made from that number are covered by these Terms.

3.5 You must not use the Service if we have suspended your access under section 12.

4. The Service

4.1 IshuriAI lets you ask questions about subjects in the Rwandan secondary school curriculum and receive short, AI-generated answers on a basic mobile phone, without internet or a smartphone. You may ask follow-up questions within the same Session.

4.2 The short code *384# is licensed by the Rwanda Utilities Regulatory Authority (RURA) under the E-Education category (license no. RURA/ICT/AUT/260770280, a temporary license valid from 17 September to 31 December 2026). The Service is currently available only on the MTN Rwanda network. We may add other networks, such as Airtel, in the future.

4.3 USSD Sessions have time and character limits set by the Operator. A Session may end if you do not respond in time, and answers may be shortened to fit the screen.

4.4 We may add, change or remove features at any time, including planned features such as a voice-call tutor, AI answers by SMS, and a school analytics dashboard. New features may come with additional terms, which we will tell you about before you use them.

4.5 We aim to keep the Service available at all times but do not guarantee it. It may be interrupted by Operator outages, network problems, maintenance or events outside our control.

5. Fees and charges

5.1 During the Pilot, the Service is free for Users. We will not charge you, and we will ask the Operator not to charge you, for Sessions during the Pilot.

5.2 After the Pilot, each Session may carry a charge, currently proposed at 50 RWF per session, similar to a standard SMS or USSD session. By January 2027 we will announce on www.ishuriai.rw whether users will pay this charge or whether Sessions stay free because a partner covers the cost. Any charge will be deducted from your airtime balance by the Operator.

5.3 Before any charge applies, we will (a) announce the end of the Pilot on www.ishuriai.rw at least 30 days in advance, and (b) show the price on screen at the start of each paid Session, so you can end the Session without being charged.

5.4 Your Operator's own tariffs, taxes and terms also apply. We are not responsible for charges set by the Operator.

5.5 If you believe you were charged in error, contact us (section 13) within 30 days and we will work with the Operator to review the charge.

6. AI-generated answers

6.1 Answers are produced automatically by artificial intelligence. They are not written or checked by a teacher before you see them.

6.2 Answers can be wrong. Although we design the Service around the Rwandan curriculum, Outputs may be incomplete, out of date, simplified to fit a small screen, or simply incorrect. Always check important answers against your textbooks, notes or teacher.

6.3 The Service is a study aid. It does not replace teachers, schools, exam guidance from the National Examination and School Inspection Authority (NESA), or professional advice.

6.4 The Service is for schoolwork only. Do not rely on it for medical, legal, financial, safety or emergency matters. In an emergency, call 112. For child protection concerns, call the free child helpline 116.

6.5 You are responsible for how you use Outputs, including in homework, assignments and exams.

7. Acceptable use and academic honesty

7.1 You agree to use the Service honestly and only for learning. You must not:

7.2 Protect your own privacy. Do not share your full name, ID number, passwords, mobile money PINs or other sensitive personal information in your questions. The Service does not need them.

7.3 We may automatically filter or block questions and answers that break these rules or that are unsuitable for young users.

8. Privacy and your data

8.1 We handle personal data in line with Law No. 058/2021 of 13/10/2021 relating to the protection of personal data and privacy, and our separate Privacy Notice at www.ishuriai.rw/privacy. rero LTD is the data controller (registration with NCSA is in progress).

8.2 What we collect: your mobile number (received from MTN through the MTN API; you are never asked to enter it), session records, the questions you send and the answers given, error logs, and anonymous yes/no feedback.

8.3 Why we use it: to run each Session and follow-up questions (contractual necessity); and to keep the Service safe, fix technical problems and improve the accuracy and curriculum fit of answers (legitimate interest). We also prepare anonymized, aggregated reports (for example, which subjects are asked about most) for Schools and Partners.

8.4 Where it is kept: our database is hosted in Kigali, Rwanda. The text of your question, without your phone number, is processed by Google's Gemini AI service to generate the answer. Under Google's paid API terms, Google does not use this data to improve its products.

8.5 Who sees it: our staff and service providers who need it to run the Service, the Operator, and authorities where the law requires. Schools and Partners receive only anonymized or aggregated information, never individual Users' questions linked to their phone numbers.

8.6 How long: conversations are kept for 180 days; session records and phone numbers for 12 months, then deleted or anonymized; error logs for 30 days; anonymous feedback is kept as aggregate statistics. We do not sell personal data or use it for advertising.

8.7 Your rights: you (or, for a child, a parent or guardian) may ask to access, correct or delete your data, or object to its use, by contacting us (section 13). You may also complain to the National Cyber Security Authority (NCSA).

9. Schools and Partners

9.1 Schools and Partners that take part in a Pilot or program will sign a separate agreement with rero. If that agreement conflicts with these Terms, the agreement prevails for that School or Partner.

9.2 A participating School agrees to (a) inform users and their parents or guardians about the Service and these Terms, and (b) not present the Service as a replacement for teaching.

9.3 Pilot data shared with Schools, Partners or funders will be anonymized or aggregated as described in section 8.5.

10. Intellectual property

10.1 The IshuriAI name and logo, the website, the software, and the way the Service is designed belong to rero LTD or its licensors. Nothing in these Terms transfers ownership of them to you.

10.2 You may use Outputs freely for your own learning, including copying them into your notes. You may not sell or republish Outputs in bulk.

10.3 You keep any rights you have in your questions. You give rero a free, non-exclusive license to use your Content to provide the Service and, after removing information that identifies you, to improve it.

11. Disclaimers and limitation of liability

11.1 The Service is provided "as is" and "as available". To the extent permitted by law, we do not promise that it will be error-free, uninterrupted, or that answers will be accurate or lead to particular exam results.

11.2 To the extent permitted by law, rero is not liable for (a) loss caused by relying on an Output, (b) Operator outages, network failures or airtime charges set by the Operator, or (c) indirect or consequential loss.

11.3 Nothing in these Terms limits liability that cannot be limited under Rwandan law, including for fraud, gross negligence, or death or personal injury caused by our negligence, or removes your rights as a consumer.

12. Suspension, changes and governing law

12.1 Suspension. We may block a phone number from the Service, temporarily or permanently, if it is used in serious or repeated breach of section 7, or if required by law, RURA or the Operator. You may stop using the Service at any time.

12.2 Ending the Service. We may end the Service, or the Pilot, with at least 30 days notice on www.ishuriai.rw, except where we must stop sooner for legal or security reasons.

12.3 Changes to these Terms. We may update these Terms. We will post the new version on www.ishuriai.rw with its effective date and, for important changes, show a notice at the start of Sessions. Continuing to use the Service after a change takes effect means you accept it.

12.4 Governing law and disputes. These Terms are governed by the laws of the Republic of Rwanda. If you have a complaint, please contact us first; we will try to resolve it within 14 days. If it is not resolved, either party may refer it to the competent courts of Rwanda in Kigali, without affecting your right to complain to RURA, NCSA or another regulator.

12.5 General. If any part of these Terms is found invalid, the rest remains in force. If we do not enforce a right immediately, we do not give it up.

1. Intangiriro no kwemera amabwiriza

1.1 Aya mabwiriza n'amategeko (« Amabwiriza ») agenga imikoreshereze yawe ya IshuriAI, serivisi y'ubwenge buhangano (AI) yigisha abanyeshuri biga mu mashuri yisumbuye, ikoreshwa hakoreshejwe kode ya USSD *384# (« Serivisi »).

1.2 Serivisi itangwa na rero LTD, ikigo cyanditswe mu Rwanda, gifite icyicaro ku 1 KN 78, Indangamirwa, Kiyovu, Nyarugenge, Kigali, u Rwanda (« rero », « twe » cyangwa « ibyacu »).

1.3 Aya Mabwiriza areba umuntu wese ukoresha Serivisi. Ashyirwa kuri www.ishuriai.rw/terms, hamwe n'Itangazo ryacu ry'ibanga kuri www.ishuriai.rw/privacy. Iyo ukanze *384# cyangwa ugakoresha Serivisi mu bundi buryo, uba wemeye aya Mabwiriza. Niba utayemeye, ntukoreshe Serivisi.

1.4 Aya Mabwiriza aboneka mu Cyongereza, mu Kinyarwanda no mu Gifaransa.

2. Ibisobanuro

3. Ushobora gukoresha Serivisi

3.1 Serivisi yagenewe abanyeshuri biga mu mashuri yisumbuye mu Rwanda. Abarimu, ababyeyi n'abandi bantu bakuru na bo bashobora kuyikoresha.

3.2 Abakoresha bari munsi y'imyaka 16. Abakoresha benshi bafite imyaka 16 cyangwa irenga. Niba ufite munsi y'imyaka 16, ukwiye gukoresha Serivisi umubyeyi cyangwa umurezi abizi, kandi ukirinda kwandika amakuru bwite mu bibazo byawe.

3.3 Ababyeyi n'abarezi. Niba umwana urera akoresha Serivisi, nyamuneka mukurikirane imikoreshereze ye. Ushobora igihe icyo ari cyo cyose kudusaba gusiba amakuru y'umwana wawe (reba igice cya 8).

3.4 Nyiri telefone. Abakoresha benshi bakoresha telefone y'umuryango. Nyiri telefone ni we ubazwa imikoreshereze y'iyo nimero, kandi session zakozwe kuri iyo nimero zigengwa n'aya Mabwiriza.

3.5 Ntugomba gukoresha Serivisi niba twarakuzitiye mu buryo buvugwa mu gice cya 12.

4. Serivisi

4.1 IshuriAI igufasha kubaza ibibazo ku masomo yo mu mashuri yisumbuye yo mu Rwanda no kubona ibisubizo bigufi bitangwa na AI kuri telefone isanzwe, nta interineti cyangwa telefone igezweho ikenewe. Ushobora kubaza ibindi bibazo bikurikiraho muri session imwe.

4.2 Kode *384# yemerewe na Rwanda Utilities Regulatory Authority (RURA) mu cyiciro cya E-Education (uruhushya nomero RURA/ICT/AUT/260770280, uruhushya rw'agateganyo rukora kuva ku wa 17 Nzeri kugeza ku wa 31 Ukuboza 2026). Ubu Serivisi iboneka gusa kuri MTN Rwanda. Dushobora kongeramo indi miyoboro nka Airtel mu gihe kizaza.

4.4 Dushobora kongeramo, guhindura cyangwa gukuraho ibiranga Serivisi igihe icyo ari cyo cyose, harimo ibyateganyijwe nk'umwarimu wo kuri telefone, ibisubizo bya AI bya SMS n'ikibaho cy'isesengura ry'amashuri. Ibishya bishobora kugira andi mabwiriza, tuzakumenyesha mbere y'uko ubikoresha.

4.5 Duharanira ko Serivisi iboneka igihe cyose, ariko ntitubizeza. Ishobora guhagarara bitewe n'ibibazo by'Ikigo cy'itumanaho, iby'urusobe, gusana cyangwa ibindi bitari mu bubasha bwacu.

5. Amafaranga n'ibiciro

5.1 Mu gihe cy'Igerageza, Serivisi ni ubuntu ku Bakoresha. Nta mafaranga tuzakwaka kandi tuzasaba Ikigo cy'itumanaho kutagira icyo kikwaka kuri session mu gihe cy'Igerageza.

5.2 Nyuma y'Igerageza, buri session ishobora kwishyurwa, ubu hateganyijwe amafaranga 50 RWF kuri session, ahwanye n'ayo kwishyura session isanzwe ya SMS cyangwa USSD. Bitarenze Mutarama 2027, tuzatangaza kuri www.ishuriai.rw niba abakoresha ari bo bazishyura ayo mafaranga cyangwa niba session zizakomeza kuba ubuntu kuko umufatanyabikorwa azayishyura. Amafaranga yose azakurwa ku mafaranga y'itumanaho ufite n'Ikigo cy'itumanaho.

5.3 Mbere yo gutangira kwishyuza, (a) tuzatangaza iherezo ry'Igerageza kuri www.ishuriai.rw nibura iminsi 30 mbere, kandi (b) tuzagaragaza igiciro kuri ecran mu itangira rya buri session yishyurwa, kugira ngo ubashe kuyihagarika utishyuye.

5.4 Ibiciro, imisoro n'amabwiriza by'Ikigo cy'itumanaho na byo biraguhame. Ntitubazwa amafaranga yashyizweho n'Ikigo cy'itumanaho.

5.5 Niba utekereza ko wishyujwe nabi, tuvugishe (igice cya 13) mu minsi 30 maze dufatanye n'Ikigo cy'itumanaho gusuzuma ayo mafaranga.

6. Ibisubizo bitangwa na AI

6.1 Ibisubizo bikorwa mu buryo bwikora n'ubwenge buhangano. Nta mwarimu ubyandika cyangwa ngo abisuzume mbere y'uko ubibona.

6.2 Ibisubizo bishobora kuba bitari byo. Nubwo Serivisi twayubatse dukurikije integanyanyigisho y'u Rwanda, Ibisubizo bishobora kutuzura, kuba bishaje, byoroheje kugira ngo bikwirwe ku cyerekezo gito, cyangwa se bitari byo. Burigihe genzura ibisubizo by'ingenzi ukoresheje ibitabo, amakaye yawe cyangwa umwarimu wawe.

6.3 Serivisi ni igikoresho cyo gufasha kwiga. Ntisimbura abarimu, amashuri, amabwiriza y'ibizamini ya NESA (Ikigo cy'Igihugu gishinzwe Ibizamini n'Ubugenzuzi bw'Amashuri), cyangwa inama z'impuguke.

6.4 Serivisi ni iy'imirimo y'ishuri gusa. Ntukayiringire ku bibazo by'ubuvuzi, amategeko, imari, umutekano cyangwa ibyihutirwa. Mu gihe cy'ibyihutirwa hamagara 112. Ku bibazo birebana no kurengera umwana hamagara 116, umurongo w'ubuntu w'abana.

6.5 Ni wowe ubazwa uko ukoresha Ibisubizo, harimo mu mikoro yo mu rugo, imishinga n'ibizamini.

7. Imikoreshereze ikwiye n'ubunyangamugayo mu myigire

7.1 Wiyemeje gukoresha Serivisi mu bunyangamugayo kandi kugira ngo wige gusa. Ntugomba:

7.2 Rinda ibanga ryawe. Ntugaragaze amazina yawe yose, nimero y'indangamuntu, amagambo y'ibanga, kode z'ibanga za mobile money cyangwa andi makuru bwite y'ingenzi mu bibazo byawe. Serivisi ntiyabikenera.

7.3 Dushobora gushungura cyangwa guhagarika mu buryo bwikora ibibazo n'ibisubizo binyuranyije n'aya mategeko cyangwa bidakwiriye urubyiruko.

8. Ibanga n'amakuru yawe

8.1 Dutunganya amakuru bwite dukurikije Itegeko n° 058/2021 ryo ku wa 13/10/2021 rirengera amakuru bwite n'ubuzima bwite, hamwe n'Itangazo ryacu ry'ibanga ryihariye riboneka kuri www.ishuriai.rw/privacy. rero LTD ni yo igenzura ikanagena uko amakuru atunganywa (kwiyandikisha muri NCSA biri gukorwa).

8.2 Ibyo dukusanya: nimero yawe ya telefone (twayihawe na MTN binyuze kuri API ya MTN; ntuzigera usabwa kuyandika), inyandiko za session, ibibazo wohereza n'ibisubizo bitangwa, inyandiko z'amakosa, n'igitekerezo kitagaragaza uwagitanze cya yego/oya.

8.3 Impamvu tubikoresha: kugira ngo buri session n'ibibazo bikurikiraho bikore (ngombwa ku masezerano); no kurinda umutekano wa Serivisi, gukosora ibibazo bya tekiniki no kunoza ukuri kw'ibisubizo n'uko bihuye n'integanyanyigisho (inyungu zemewe). Dutegura kandi raporo zihuriweho zitagaragaza abantu (urugero, amasomo abazwa cyane) z'Amashuri n'Abafatanyabikorwa.

8.4 Aho bibikwa: ububiko bwacu bw'amakuru buri i Kigali mu Rwanda. Umwandiko w'ikibazo cyawe, hatarimo nimero yawe ya telefone, utunganywa na serivisi ya AI ya Google yitwa Gemini kugira ngo hatangwe igisubizo. Hakurikijwe amabwiriza ya Google ya API yishyurwa, Google ntikoresha ayo makuru mu kunoza ibicuruzwa byayo.

8.5 Ubifitiye uburenganzira: abakozi bacu n'abatanga serivisi bayakeneye kugira ngo Serivisi ikore, Ikigo cy'itumanaho, n'inzego z'ubutegetsi igihe itegeko ribisaba. Amashuri n'Abafatanyabikorwa bahabwa gusa amakuru atagaragaza abantu cyangwa yahurijwe hamwe, ntibigera bahabwa ibibazo by'Ukoresha bihujwe na nimero ye ya telefone.

8.6 Igihe bibikwa: ibiganiro bibikwa iminsi 180; inyandiko za session na nimero za telefone bibikwa amezi 12, hanyuma bigasibwa cyangwa bigakurwaho ibiranga nyirabyo; inyandiko z'amakosa zibikwa iminsi 30; ibitekerezo bitagaragaza ubitanze bibikwa nk'imibare ihuriweho. Ntitugurisha amakuru bwite kandi ntitwayakoresha mu kwamamaza.

8.7 Uburenganzira bwawe: wowe (cyangwa, ku mwana, umubyeyi cyangwa umurezi) ushobora gusaba kubona amakuru yawe, kuyakosoza, kuyasibisha, cyangwa kwanga ko akoreshwa, utuvugishije (igice cya 13). Ushobora kandi gutanga ikirego ku Kigo cy'Igihugu gishinzwe Umutekano w'Ikoranabuhanga (NCSA).

9. Amashuri n'abafatanyabikorwa

9.1 Amashuri n'Abafatanyabikorwa bagira uruhare mu igerageza cyangwa muri gahunda basinyana na rero amasezerano yihariye. Aya masezerano n'aya Mabwiriza nihabaho kudahuza, amasezerano ni yo akurikizwa ku Ishuri cyangwa Umufatanyabikorwa bireba.

9.2 Ishuri ribigiramo uruhare ryiyemeje (a) kumenyesha Abakoresha n'ababyeyi cyangwa abarezi babo ibya Serivisi n'aya Mabwiriza, na (b) kutagaragaza Serivisi nk'isimbura imyigishirize.

9.3 Amakuru y'Igerageza asangizwa Amashuri, Abafatanyabikorwa cyangwa abaterankunga azakurwaho ibiranga abantu cyangwa ahurizwe hamwe nk'uko bivugwa mu gice cya 8.5.

10. Uburenganzira ku mitungo yo mu mutwe

10.1 Izina n'ikirango bya IshuriAI, urubuga, porogaramu n'imiterere ya Serivisi ni ibya rero LTD cyangwa abayiha uruhushya. Nta na kimwe muri aya Mabwiriza kiguhesha nyirabyo.

10.2 Ushobora gukoresha Ibisubizo ku buntu mu myigire yawe, harimo kubyandukura mu makaye yawe. Ntushobora gucuruza cyangwa kongera gutangaza Ibisubizo ku bwinshi.

10.3 Ukomeza kugira uburenganzira ufite ku bibazo byawe. Uha rero LTD uruhushya rutishyuzwa kandi rudahariwe rwo gukoresha Ibyo wohereje kugira ngo itange Serivisi kandi, nyuma yo gukuramo amakuru agaragaza uwabyohereje, kugira ngo iyinoze.

11. Kwisubiraho ku mpamvu zitandukanye n'imbibi z'inshingano

11.1 Serivisi itangwa « uko iri » kandi « uko iboneka ». Mu rugero itegeko ryemera, ntituvuga ko izaba itarimo amakosa cyangwa idahagarara, cyangwa ko ibisubizo bizaba ari byo cyangwa bizatanga amanota runaka mu bizamini.

11.2 Mu rugero itegeko ryemera, rero ntiryirengera (a) igihombo giturutse ku kwiringira Igisubizo, (b) ibibazo by'Ikigo cy'itumanaho, kudakora kw'urusobe cyangwa amafaranga y'itumanaho yashyizweho n'Ikigo cy'itumanaho, cyangwa (c) igihombo kidaturutse ku buryo butaziguye.

11.3 Nta kintu kiri muri aya Mabwiriza gikuraho inshingano zidashobora gukurwaho n'amategeko y'u Rwanda, harimo uburiganya, uburangare bukabije, cyangwa urupfu cyangwa gukomereka biturutse ku burangare bwacu, ndetse nta n'ubwo gikuraho uburenganzira bwawe nk'umuguzi.

12. Guhagarika, impinduka n'amategeko akurikizwa

12.1 Guhagarika. Dushobora guhagarika nimero ya telefone by'agateganyo cyangwa burundu niba ikoreshejwe binyuranyije cyane cyangwa kenshi n'igice cya 7, cyangwa niba itegeko, RURA cyangwa Ikigo cy'itumanaho bibisabye. Ushobora guhagarika gukoresha Serivisi igihe icyo ari cyo cyose.

1. Introduction et acceptation

1.1 Les présentes conditions générales (les « Conditions ») régissent votre utilisation d'IshuriAI, un service de tutorat par intelligence artificielle destiné aux élèves du secondaire, accessible par le code court USSD *384# (le « Service »).

1.2 Le Service est fourni par rero LTD, société enregistrée au Rwanda, dont le siège est situé au 1 KN 78, Indangamirwa, Kiyovu, Nyarugenge, Kigali, Rwanda (« rero », « nous » ou « notre »).

1.3 Les présentes Conditions s'appliquent à toute personne qui utilise le Service. Elles sont publiées sur www.ishuriai.rw/terms, avec notre Notice de confidentialité sur www.ishuriai.rw/privacy. En composant *384# ou en utilisant autrement le Service, vous acceptez ces Conditions. Si vous ne les acceptez pas, n'utilisez pas le Service.

1.4 Les présentes Conditions sont disponibles en anglais, en kinyarwanda et en français.

2. Définitions

Terme Signification
Utilisateur Toute personne qui utilise le Service, y compris les élèves, les enseignants et les parents.
Parent ou tuteur La personne qui exerce l'autorité parentale légale sur un Utilisateur de moins de 18 ans.
École Un établissement scolaire ou une institution qui participe à un projet pilote ou à un programme IshuriAI.
Partenaire Un bailleur de fonds, un opérateur de téléphonie mobile ou une autre organisation qui travaille avec rero sur le Service.
Session Une interaction USSD continue qui commence lorsque *384# est composé et se termine à l'expiration du délai ou à la fermeture.
Contenu Les questions, messages et autres informations que vous envoyez au Service.
Réponse Les réponses et autres contenus générés par le Service.
Projet pilote La phase d'introduction gratuite du Service, annoncée par rero.
Opérateur Le réseau mobile que vous utilisez pour accéder au Service, actuellement MTN Rwanda.

3. Qui peut utiliser le Service

3.1 Le Service est conçu pour les élèves du secondaire au Rwanda. Les enseignants, les parents et d'autres adultes peuvent également l'utiliser.

3.2 Utilisateurs de moins de 16 ans. La plupart des utilisateurs ont 16 ans ou plus. Si vous avez moins de 16 ans, vous devriez utiliser le Service à la connaissance d'un parent ou d'un tuteur, et ne pas saisir de renseignements personnels dans vos questions.

3.3 Parents et tuteurs. Si un enfant dont vous avez la charge utilise le Service, veuillez guider son utilisation. Vous pouvez à tout moment nous demander de supprimer les données de votre enfant (voir section 8).

3.4 Propriété du téléphone. De nombreux utilisateurs se servent d'un téléphone appartenant à un membre de leur famille. Le propriétaire du téléphone est responsable de l'utilisation de son numéro, et les sessions effectuées depuis ce numéro sont couvertes par les présentes Conditions.

3.5 Vous ne devez pas utiliser le Service si nous avons suspendu votre accès en vertu de la section 12.

4. Le Service

4.1 IshuriAI vous permet de poser des questions sur les matières du programme du secondaire rwandais et de recevoir de courtes réponses générées par l'IA sur un téléphone mobile basique, sans internet ni smartphone. Vous pouvez poser des questions complémentaires au cours de la même Session.

4.2 Le code court *384# est autorisé par l'Autorité rwandaise de régulation des services publics (RURA) dans la catégorie E-Education (licence n° RURA/ICT/AUT/260770280, licence temporaire valable du 17 septembre au 31 décembre 2026). Le Service n'est actuellement disponible que sur le réseau MTN Rwanda. Nous pourrons ajouter d'autres réseaux, comme Airtel, à l'avenir.

4.3 Les Sessions USSD sont soumises à des limites de durée et de caractères fixées par l'Opérateur. Une Session peut prendre fin si vous ne répondez pas à temps, et les réponses peuvent être raccourcies pour tenir à l'écran.

4.4 Nous pouvons ajouter, modifier ou supprimer des fonctionnalités à tout moment, y compris des fonctionnalités prévues telles qu'un tuteur par appel vocal, des réponses de l'IA par SMS et un tableau de bord d'analyse pour les écoles. De nouvelles fonctionnalités peuvent être soumises à des conditions supplémentaires, dont nous vous informerons avant que vous ne les utilisiez.

4.5 Nous nous efforçons de maintenir le Service disponible en permanence, mais ne le garantissons pas. Il peut être interrompu par des pannes de l'Opérateur, des problèmes de réseau, des opérations de maintenance ou des événements indépendants de notre volonté.

5. Frais et tarifs

5.1 Pendant le projet pilote, le Service est gratuit pour les Utilisateurs. Nous ne vous facturerons rien et nous demanderons à l'Opérateur de ne rien vous facturer pour les Sessions pendant le projet pilote.

5.2 Après le projet pilote, chaque Session pourra donner lieu à des frais, actuellement proposés à 50 RWF par session, comparables à ceux d'une session SMS ou USSD standard. D'ici janvier 2027, nous annoncerons sur www.ishuriai.rw si les utilisateurs paieront ces frais ou si les Sessions resteront gratuites parce qu'un partenaire en prend le coût en charge. Tout frais sera déduit de votre crédit de communication par l'Opérateur.

5.3 Avant toute facturation, nous (a) annoncerons la fin du projet pilote sur www.ishuriai.rw au moins 30 jours à l'avance, et (b) afficherons le prix à l'écran au début de chaque Session payante, afin que vous puissiez y mettre fin sans être facturé.

5.4 Les tarifs, taxes et conditions de votre Opérateur s'appliquent également. Nous ne sommes pas responsables des frais fixés par l'Opérateur.

5.5 Si vous pensez avoir été facturé par erreur, contactez-nous (section 13) dans un délai de 30 jours et nous travaillerons avec l'Opérateur pour examiner la facturation.

6. Réponses générées par l'IA

6.1 Les réponses sont produites automatiquement par intelligence artificielle. Elles ne sont ni rédigées ni vérifiées par un enseignant avant que vous ne les voyiez.

6.2 Les réponses peuvent être erronées. Bien que nous concevions le Service autour du programme rwandais, les Réponses peuvent être incomplètes, dépassées, simplifiées pour tenir sur un petit écran, ou tout simplement inexactes. Vérifiez toujours les réponses importantes à l'aide de vos manuels, de vos notes ou de votre enseignant.

6.3 Le Service est une aide à l'étude. Il ne remplace ni les enseignants, ni les écoles, ni les consignes relatives aux examens de l'Autorité nationale des examens et de l'inspection scolaire (NESA), ni les conseils de professionnels.

6.4 Le Service est réservé au travail scolaire. Ne vous y fiez pas pour des questions médicales, juridiques, financières, de sécurité ou d'urgence. En cas d'urgence, appelez le 112. Pour toute question de protection de l'enfance, appelez la ligne d'assistance gratuite pour les enfants au 116.

6.5 Vous êtes responsable de l'usage que vous faites des Réponses, y compris dans les devoirs, travaux et examens.

7. Utilisation acceptable et honnêteté académique

7.1 Vous vous engagez à utiliser le Service honnêtement et uniquement pour apprendre. Vous ne devez pas :

7.2 Protégez votre vie privée. Ne communiquez pas votre nom complet, votre numéro d'identité, vos mots de passe, vos codes PIN de mobile money ou d'autres informations personnelles sensibles dans vos questions. Le Service n'en a pas besoin.

7.3 Nous pouvons filtrer ou bloquer automatiquement les questions et réponses qui enfreignent ces règles ou qui ne conviennent pas aux jeunes utilisateurs.

8. Confidentialité et vos données

8.1 Nous traitons les données personnelles conformément à la Loi n° 058/2021 du 13/10/2021 relative à la protection des données personnelles et de la vie privée, et à notre Notice de confidentialité distincte, disponible sur www.ishuriai.rw/privacy. rero LTD est le responsable du traitement (l'enregistrement auprès du NCSA est en cours).

8.2 Ce que nous collectons : votre numéro de téléphone mobile (reçu de MTN par l'intermédiaire de l'API de MTN ; il ne vous est jamais demandé de le saisir), les enregistrements de sessions, les questions que vous envoyez et les réponses fournies, les journaux d'erreurs et les retours anonymes oui/non.

8.3 Pourquoi nous les utilisons : pour faire fonctionner chaque Session et les questions complémentaires (nécessité contractuelle) ; et pour assurer la sécurité du Service, corriger les problèmes techniques et améliorer l'exactitude et l'adéquation des réponses au programme (intérêt légitime). Nous préparons également des rapports anonymisés et agrégés (par exemple, les matières les plus demandées) à l'intention des Écoles et des Partenaires.

8.4 Où elles sont conservées : notre base de données est hébergée à Kigali, au Rwanda. Le texte de votre question, sans votre numéro de téléphone, est traité par le service d'IA Gemini de Google pour générer la réponse. Selon les conditions de l'API payante de Google, Google n'utilise pas ces données pour améliorer ses produits.

8.5 Qui y a accès : notre personnel et les prestataires de services qui en ont besoin pour faire fonctionner le Service, l'Opérateur, et les autorités lorsque la loi l'exige. Les Écoles et les Partenaires ne reçoivent que des informations anonymisées ou agrégées, jamais les questions d'un Utilisateur associées à son numéro de téléphone.

8.6 Durée de conservation : les conversations sont conservées pendant 180 jours ; les enregistrements de sessions et les numéros de téléphone pendant 12 mois, puis supprimés ou anonymisés ; les journaux d'erreurs pendant 30 jours ; les retours anonymes sont conservés sous forme de statistiques agrégées. Nous ne vendons pas de données personnelles et ne les utilisons pas à des fins publicitaires.

8.7 Vos droits : vous (ou, pour un enfant, un parent ou tuteur) pouvez demander l'accès à vos données, leur rectification ou leur suppression, ou vous opposer à leur utilisation, en nous contactant (section 13). Vous pouvez également déposer une plainte auprès de l'Autorité nationale de cybersécurité (NCSA).

9. Écoles et partenaires

9.1 Les Écoles et les Partenaires qui participent à un projet pilote ou à un programme signeront un accord distinct avec rero. En cas de conflit entre cet accord et les présentes Conditions, l'accord prévaut pour l'École ou le Partenaire concerné.

9.2 Une École participante s'engage à (a) informer les utilisateurs et leurs parents ou tuteurs au sujet du Service et des présentes Conditions, et (b) ne pas présenter le Service comme un remplacement de l'enseignement.

9.3 Les données du projet pilote partagées avec des Écoles, des Partenaires ou des bailleurs de fonds seront anonymisées ou agrégées comme décrit à la section 8.5.

10. Propriété intellectuelle

10.1 Le nom et le logo IshuriAI, le site web, le logiciel et la conception du Service appartiennent à rero LTD ou à ses concédants de licence. Rien dans les présentes Conditions ne vous en transfère la propriété.

10.2 Vous pouvez utiliser librement les Réponses pour votre propre apprentissage, y compris en les copiant dans vos notes. Vous ne pouvez pas vendre ni republier les Réponses en masse.

10.3 Vous conservez les droits que vous détenez sur vos questions. Vous accordez à rero une licence gratuite et non exclusive d'utilisation de votre Contenu pour fournir le Service et, après suppression des informations qui vous identifient, pour l'améliorer.

11. Exclusions de garantie et limitation de responsabilité

11.1 Le Service est fourni « en l'état » et « selon disponibilité ». Dans la mesure permise par la loi, nous ne promettons pas qu'il sera exempt d'erreurs ou ininterrompu, ni que les réponses seront exactes ou mèneront à des résultats d'examen particuliers.

11.2 Dans la mesure permise par la loi, rero n'est pas responsable (a) des pertes causées par le fait de s'être fié à une Réponse, (b) des pannes de l'Opérateur, des défaillances de réseau ou des frais de communication fixés par l'Opérateur, ou (c) des pertes indirectes ou consécutives.

11.3 Aucune disposition des présentes Conditions ne limite la responsabilité qui ne peut être limitée en vertu du droit rwandais, notamment en cas de fraude, de négligence grave, ou de décès ou de dommage corporel causé par notre négligence, ni ne supprime vos droits en tant que consommateur.

12. Suspension, modifications et droit applicable

12.1 Suspension. Nous pouvons bloquer un numéro de téléphone, temporairement ou définitivement, s'il est utilisé en violation grave ou répétée de la section 7, ou si la loi, la RURA ou l'Opérateur l'exige. Vous pouvez cesser d'utiliser le Service à tout moment.

12.2 Fin du Service. Nous pouvons mettre fin au Service, ou au projet pilote, moyennant un préavis d'au moins 30 jours sur www.ishuriai.rw, sauf si nous devons arrêter plus tôt pour des raisons légales ou de sécurité.

12.3 Modification des Conditions. Nous pouvons mettre à jour les présentes Conditions. Nous publierons la nouvelle version sur www.ishuriai.rw avec sa date d'entrée en vigueur et, pour les changements importants, afficherons un avis au début des Sessions. Continuer à utiliser le Service après l'entrée en vigueur d'une modification signifie que vous l'acceptez.

12.4 Droit applicable et litiges. Les présentes Conditions sont régies par le droit de la République du Rwanda. Si vous avez une réclamation, veuillez d'abord nous contacter ; nous nous efforcerons de la résoudre dans un délai de 14 jours. Si elle n'est pas résolue, l'une ou l'autre des parties peut saisir les tribunaux compétents du Rwanda à Kigali, sans préjudice de votre droit de déposer une plainte auprès de la RURA, du NCSA ou d'une autre autorité de régulation.

12.5 Dispositions générales. Si une partie des présentes Conditions est jugée invalide, le reste demeure en vigueur. Si nous n'exerçons pas immédiatement un droit, nous n'y renonçons pas.
